Terms and Conditions Welcome to the platform! By using this website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully. (A) Artists Ticking the below mandatory check box means that I have read and agreed to the Mandatory Terms and Conditions of using this website (also known as "the platform"): Mandatory Terms and Conditions - Earnings: You agree that your earnings from this platform will be based on the "EARNINGS SCHEDULE" below, which is directly dependent on your overall positioning per your allocated group. - You hereby warrant that you are legally an adult (more than 18 years) of age. - You hereby warrant that this Art being uploaded is your original work, or - You hereby warrant that you have obtained permission from the copyright holder of the Art for uploading the Art or part of its contents in this platform (in all media including print and electronic form) material not owned by you, and that you have acknowledged the source; - You hereby warrant that this Art contains no violation of any existing copyright or other third-party right or any material of an obscene, indecent, libelous or otherwise unlawful nature and that to the best of your knowledge this Art does not infringe the rights of others; - You hereby warrant that in the case of a multi-authored Art you have obtained, in writing, authorization to enter into this Agreement on their behalf and that all co-authors have read and agreed the terms of this Agreement; - You further agree that the platform reserves all the right to refrain from uploading this Art, or any parts of it, in the event that the Art or any contents of it breaches any of the above 1 to 4 mandatory terms. - You will indemnify and compensate all persons in all claims and expenses (including legal costs and expenses) arising from any breach of this warranty and the other warranties on your behalf in this Agreement. - You authorize the platform to act on your behalf to defend your copyright in the Art if anyone should infringe it, provided you possess legal rights of ownership on the art, although there is no obligation on the platform to act in this way. ARTISTS EARNING SCHEDULE Payments For Artists Position in the group (*) X Percentage Of Total Group Earnings (**) - First Position: 4% - Second Position: 3% - Third Position: 2% - Fourth Position: 1% - Fifth Position: 1% Your position is based on the aggregate results from ratings by all votes (single votes). ** The total group earnings are determined by the formula: Total earnings = Total group earnings from voters in that group. NB: Payments are only made by the end of the month. When selling your file, you get 85% from the selling price you would have charged. However, a badge code may be entered by a buyer at checkout point to increase your cut to 95% of the selling price. You can purchase a code either physically at our office in town or through Ecocash (+263 780 824 356 or +263 781 631 274) or Paynow. *How to Vote For Artists Content* - Vote skillfully by considering the quality of the Artist's file as well as the Artist's level of popularity. - Your voting choice should accurately align with the aggregate choices generally accepted by all, ie, matching with the fair position of all 5 Artists in a group by the end of the talent rating session. - The first 3% of accurate voters will be the badge winners (first come first serve). - If more than 1 Voter win their 5th badges at the same time, then they equally share the total number of complete voters available at that time. *How to Lose A Badge* - You only lose your badge of you sell it to an anyone. - You do not lose a badge by attending a concert for free. Happy Art Rating If you want to repeat a vote within the same group, then the secondary, third, fourth and fifth votes will be $2 each. We will use methods like OTPs to verify your identity as a voter. NOTE: ADMINS WILL MONITOR YOUR ACTIVITY WITHIN THE PLATFORM. ANY FORM OF OFFENSIVE SPEECH, VULGAR LANGUAGE, OR ANY DISCRIMINATORY ACTIVITY WILL NOT BE TOLERATED AND MAY RESULT IN YOUR ACCOUNT BEING TERMINATED. (C) Voting Sessions - Admin decides group assignments (Artists may request preferences). Any schedule changes will be communicated by Admins. *Introduction To Genius Games* (NB: The terms of the games don't interlink with those above for Artists. Hence, badges or OTPs earned or bought from games do not attract the benefits similar to benefits from badges of Artists Fans above) *Genius Games Reloaded* _Welcome to Genius Games, we appreciate you continuing with us ☺️_ *Please take note of the below updates to the Games Flow* *1. Registration To Play* - Registration fee is now $1 for 50 plays per month. - You can play freely without paying the registration fee. - But, once you reach 10 points and you want to cash out, we will withhold from your $10 all the money you were supposed to pay all along, pluz 20% interest for late payment. *2. Points Tracker* - Each point now weighs 0.01 points. - Points are calculated as follows: - *Riddles:* Calculations say the more players get it wrong, the more points to those who get it right. - *Debates:* Calculations say, the more reactions you get, the more points to you. - *Talent Ratings:* Calculations are same as for riddles. - *Genius Chains:* Calculations say you score a chain then you get a point (0.01). - Therefore, the easier the better for the Chain Master. *3. Cashing Out* - When you reach 10 points, _you have 2 options:_ - *Option 1*: You cash out $10. - Then from that your points continue growing normally. - You then cash out another $10 nxa usule 20 points, etc, etc. - *Option 2*: You don't cash out your $10, but you leave it there. - If you choose option 2, then your points will grow with an addition of 10% of your invested amount. - So you will be able to grow them faster because you re invested your $10 back. - You can cash out all or part of your points, but in multiples of 10. - For example, when you reach 50 points without ever withdrawing, you can withdraw $50, or only withdraw $20 and leave the other $30 (it's up to you). - One only cashes out when their points are at a multiples of 10 level. *4.Selling of Accounts* - You are allowed to sell your account to someone. - But you cannot sell points to another person. Only the whole account can be sold. *5. Uploading of Content* - *Artists Files* - Musicians, poets, comedians, beauties, etc, can upload their files for talent ratings (free of charge) - But, for the files to participate in ratings, there should be atleast a stated number of people who nominate the files through reactions on it, before it's approved for talent ratings. - Each Artist gets 0.004, 0.003, 0.002, 0.001 and 0.001 (From position 1 to Position 5, respectively, per each Rater) - *Riddle Masters* - Playing a riddle that you uploaded yourself gives you an advantage over others. - So to upload a riddle, players will pay to do that. - We will accept the good payer and good riddle as well. - Riddle Masters earn 0.01 points per each responder to their riddle. - *Debate Moderators* - To upload a debate topic, you will also need to pay, just like the Riddles Masters. - Debate Moderators get 0.01 points per each comment to their topic. - *Genius Chain Leaders* - This is someone who wants to design a word chain or begin the first word in the chain.. - They also need to pay to do that. - Chain Leaders get 0.01 points per each player they win. _*Disclaimer:*_ Points calculation formula are a personal property of Genre Genius and we thus reserve a right to reveal only the parts we feel safe to release.
